ANGLETON, Texas -- The third trial of a Texas welding fume case that had previously ended in a hung jury and a defense verdict has been scheduled for April 2007, sources told HarrisMartin. Presler v. Lincoln Electric Co., No. 23472 (Texas 23rd Dist. Ct., Brazoria Cty.).

The 23rd District Court for Brazoria County docket lists the official trial setting as April 9, 2007. In April 2006, the Texas Supreme Court denied a writ of mandamus, effectively ending defense efforts to challenge a trial court order granting the new trial.
