Missouri Court Allows Conspiracy Claim in Talc Ovarian Cancer Suit

ST. LOUIS –– A Missouri court has rejected efforts to dismiss a conspiracy claim in a talcum powder ovarian cancer suit, ruling that the plaintiff met pleading requirements by alleging that several of the defendants, including Johnson & Johnson, conspired to conceal the potential hazards of using the product.

In the Dec. 4 memorandum and order, the U.S. District Court for the Eastern District of Missouri dismissed the plaintiff’s concert of action claim, however, ruling it is an element of a conspiracy claim in a product liability setting and not a separate cause of action.
