Antibiotic Injury Cases to Stay in Minnesota, Judge Says

MINNEAPOLIS - A judge has refused to transfer the claims of six out-of-state plaintiffs who opted to filed suit in a Minnesota court after allegedly suffered tendon injuries after ingesting an antibiotic they say is defectively designed. Voss v. Johnson & Johnson, et al., No. 07-1661 (D. Minn.).

Judge John R. Tunheim of the U.S. District Court for the District of Minnesota said in a March 12 opinion that the defendants failed, in this stage of the proceedings, to show that convenience and the interests of justice dictate that the cases should be heard in the plaintiffs' home judicial districts.
