PHILADELPHIA - A state court judge who reversed a $1.5 million verdict in favor of a plaintiff claiming she developed breast cancer after years of taking hormone replacement therapy has issued an opinion explaining that the claim was time-barred. Simon v. Wyeth Pharmaceuticals Inc., et al., No. 060404229 (Pa. Comm. Pls., Philadelphia Cty.).
According to a Dec. 26 decision by Philadelphia County Common Pleas Court Judge Nitza I. Quinones Alejandro, the two-year statute of limitations began running on Merle Simon's personal injury claim the day she was diagnosed with breast cancer.
