Lens Solution Maker Sues Insurers After Settlement Exhausts Coverage

ROCHESTER, N.Y. - Bausch & Lomb Inc. recently sued several insurance companies, claiming they must continue to defend and indemnify the company against Renu MoistureLoc claims now that a significant settlement exhausted the company's primary coverage for the claims. Bausch & Lomb Inc. v. ACE American Insurance Co., No. 2007/014836 (N.Y. Sup. Ct., Monroe Cty.).
The lawsuit, filed Nov. 9 in Monroe County Supreme Court, N.Y., stems from a difference of opinion as to whether the contact lens solution claims constitute one or multiple occurrences within the context of the parties' insurance coverage agreement.
