Judge Says N.J. Law Applies to Alabama Man's PPA Claim

NEW BRUNSWICK, N.J. - A New Jersey Superior Court judge has ruled that New Jersey law applies to an Alabama man's PPA injury claim, not Alabama as J.B. Laboratories had argued. Smith v. Novartis, et al. No. MID-L-9872-02 (N.J. Sup. Ct.).
On Sept. 1, Judge Bryan D. Garruto of the New Jersey Superior Court denied J.B. Labs' motions for summary judgment and for declaratory relief, finding that because Acutrim, the product that plaintiff Roger Smith says caused his stroke, was packaged and labeled in New Jersey, the state's laws are applicable to his claims.
