CORPUS CHRISTI, Texas - Two Aventis defendants were dismissed from a polio vaccine lawsuit on Nov. 29 after arguing that the plaintiff had previously dismissed the companies in her first amended complaint. Garcia v. Aventis, et al. No. 2:04-cv-00112 (S.D. Texas).
Sarita I. Garcia sued Aventis, Wyeth, Lederle Laboratories, Pfizer Inc. and 29 other pharmaceutical manufacturers in the 28th Judicial District Court of Nueces County, Texas, on Feb. 20, 2004 (No. 04-935-A). Her case was removed to the U.S. District Court for the Southern District of Texas on March 19, 2004.
