DENVER - An Oklahoma man responded on Sept. 6 to AstraZeneca's appeal of his Crestor lawsuit, disputing the company's argument that he fraudulently joined a sales representative to avoid federal jurisdiction.Nerad v. AstraZeneca Pharmaceuticals, et al. No. 05-6128 (10th Cir.).

Ron Nerad sued AstraZeneca in November in the District Court of Canadian County, Okla., claiming the cholesterol-reducing drug Crestor (rosuvastatin calcium) was unreasonably dangerous and caused him unspecified injuries. He contends that AstraZeneca failed to properly warn consumers about potential side effects, and did not exercise ordinary care in its manufacture, testing and sales.
