BOSTON - A Maine woman who alleges that medication taken to control obsessive/compulsive disorder caused manic episodes has asked the 1st Circuit U.S. Court of Appeals to reverse summary judgment granted the drug's manufacturer. Doe v. Solvay Pharmaceuticals, Inc., No. 05-1065 (1st Cir.).

The U.S. District Court for the District of Maine awarded summary judgment to Solvay Pharmaceuticals on Dec. 21, finding no evidence to support 'Jane Doe's' product defect claim and finding her failure to warn claim barred by the learned intermediary doctrine (Doe v. Solvay Pharmaceuticals, No. 03-74-B-W, D. Maine).
