PENSACOLA, Fla. — A Florida federal judge dismissed claims for strict products liability and breach of implied warranty in a case in which a man alleges he was implanted with a human tissue allograft implant that was contaminated with tuberculosis.

In a case that was later settled on Sept. 6, Judge M. Casey Rodgers of the U.S. District Court for the Northern District of Florida explained that given the lack of Florida case law interpreting the state’s human tissue shield statute, she could not make an educated guess as to how the state high court would rule.
