KANSAS CITY, Kan. - A couple recently filed suit against Metabolife International, Inc., and Colorado-based Chemins Company, seeking to recover damages for cardiac injuries the husband sustained allegedly as a result of using Metabolife 356, a dietary supplement containing ephedra and caffeine. Gerald Portillo and Josephine Portillo v. Metabolife International, Inc., et al. No 04-2032-KHV (D. Kan.).

The Jan. 26 complaint states that the companies are liable for plaintiff Gerald Portillo's injuries because they failed to adequately test the supplement for safety and failed to warn consumers of the product's ability to cause adverse events such as heart attacks, strokes, …
