MDL Judge Extends Discovery for Non-Liver Injury Plaintiffs Responding to Summary Judgment Motions

NEW YORK - The federal judge presiding over the Rezulin MDL granted plaintiffs' motion to extend the deadline to respond to the manufacturer's motion for summary judgment in non-liver injury cases in order to conduct additional discovery. In re: Rezulin Products Liability Litigation, MDL No. 1348 (S.D.N.Y.).

U.S. District Judge Lewis A. Kaplan's Dec. 22, 2003, order also allowed plaintiffs to submit affidavits and expert reports in connection with their response to the pending summary judgment motion by Jan. 15.
