Ala. Federal Judge Addresses Defendants’ Daubert Arguments in Ethicon Pelvic Mesh Case

MONTGOMERY, Ala. — A federal judge has reserved for trial certain portions of defendants’ motion to exclude the testimony of expert Dr. Bruce Rosenzwieg in an action in which an Alabama woman alleges that Ethicon’s TVT-O pelvic mesh device caused her to suffer numerous complications.

On Feb. 7, Judge W. Keith Watkins of the U.S. District Court for the Middle District of Alabama said he will address whether Dr. Rosenzweig may opine that certain procedures and devices were reasonably feasible safer alternatives, and whether laser cut TVT mesh is a safer alternative to mechanically cut TVT mesh.
