MADISON, Wis. — A Wisconsin federal judge has denied Boston Scientific Corp.’s motion for summary judgment on design defect claims in a pelvic mesh action, ruling there is a genuine issue of fact as to whether there was a reasonable alternative design to the Obtryx device.
In a Dec. 2 order, Judge James D. Peterson of the U.S. District Court for the Western District of Wisconsin found the plaintiff presented sufficient evidence that a pelvic mesh product can be made with a variety of mesh styles, or that it need not be made with polypropylene at all.
