N.Y. Federal Judge Strikes DePuy-Related Opinions in Plaintiffs’ Expert Report

NEW YORK — A New York federal judge has granted DePuy Orthopaedics Inc.’s motion to strike the DePuy-related opinions offered by plaintiffs’ alternate engineer expert, Dr. John Jarrell, in a hip replacement action, ruling that such testimony “would constitute improper scope creep for a substitute expert.”

In a Nov. 24 order, Magistrate Judge Stewart Aaron of the U.S. District Court for the Southern District of New York explained that the alternate engineering expert’s report does not fall within the same scope of subject areas as those covered by the plaintiff’s Prior Engineer Expert.
