Expert May Opine as to Standard of Care for Warning Patients at Taxotere Trial

NEW ORLEANS — A plaintiff’s expert may testify about the standard of care for informing patients through the decision-making process in an upcoming Taxotere bellwether trial, a Louisiana federal judge has ruled, but may not testify about how the plaintiff’s prescribing doctor would have responded to an adequate warning from defendants.

In an Aug. 5 order, Judge Jane T. Milazzo of the U.S. District Court for the Eastern District of Louisiana ruled that Dr. Linda Bosserman may also offer her opinion about the guidelines from the National Comprehensive Cancer Network and what they require.
