6th Cir. Says it Lacks Jurisdiction Over Ruling in ASR Hip Fee Dispute

CINCINNATI — A federal appeals court says it lacks jurisdiction over an Ohio federal court’s ruling that an attorney’s fee dispute should be heard by the court overseeing the DePuy ASR hip implant MDL docket, explaining that the ruling is not a “final, appealable decision.”

In a Nov. 30 opinion, the 6th Circuit U.S. Court of Appeals found that the ruling did not resolve the case because the trial court did not address the attorney’s motion to confirm an arbitration award in his favor.
