FORT MYERS, Fla. — Corin Group has asserted numerous affirmative defenses, including preemption, learned intermediary, contributory negligence and failure to state a claim, in a Florida federal action targeting its Cormet System hip replacement device.
In its answer filed in the U.S. District Court for the Middle District of Florida noted Corin further asserts that any injuries or damages were proximately caused by the plaintiff’s physical, bodily or mental condition before, during and after implantation of the artificial hip.
