Pinnacle Plaintiffs Oppose Efforts to Remove 3 Cases from Bellwether Trial Pool

DALLAS –– Plaintiffs with claims pending in the national Pinnacle Hip Implant multidistrict litigation docket have opposed a defense motion to remove three cases from inclusion in the next bellwether trial pool, maintaining that “it is not unusual that one of the Defendants’ paid surgeons had patients who have filed lawsuits in this MDL.”

In the Nov. 5 response filed in the U.S. District Court for the Northern District of Texas, the plaintiffs said that a trial in these cases will be instructive to both the court and the parties.
