Calif. Court Throws Out Stryker Hip Replacement Suit; Denies Leave to Amend

SAN FRANCISCO - A California court has granted Stryker Corp.’s motion to dismiss an Accolade System hip replacement system action, opining that the plaintiffs had once again failed to identify any defect in the product or any warning that should have accompanies the product.
In the Oct. 16 order, the U.S. District Court for the Northern District of California also denied the plaintiffs a chance to re-plead their claims, noting that they have had “multiple opportunities to cure the other deficiencies described above, and … cannot rely on discovery to supply the missing elements of his claim.”
