Judge Denies Certification for Proposed Nationwide Paxil Class




LOS ANGELES - On. Jan. 10, U.S. District Judge Marianna Pfaelzer denied the plaintiff's motion to establish a nationwide class for individuals who allegedly suffered from withdrawal symptoms after discontinuing the use of Paxil. In re: Paxil Litigation, No. 01-07937 (C.D. Calif.).

Judge Pfaelzer's opinion stated that the proposed multi-state class would be difficult to manage due to variations in state law.

'With this many putative plaintiffs, Plaintiffs should have no problem forming that are large enough to justify the litigation expenses,' Judge Pfaelzer wrote.
