Zimmer Opposes Motion for Sanctions in NexGen Knee Implant Docket; Says Neither Party Prejudiced

CHICAGO –– Zimmer has opposed a recent motion for sanctions filed in the NexGen Knee Implant Products Liability Multidistrict Litigation docket, saying that an agreement between the parties allowed for documents relied upon by experts to be produced at the deposition of the party.

In a response brief filed Feb. 2 in the U.S. District Court for the Northern District of Illinois, Zimmer maintained that neither party has suffered prejudice and that “the process has played out precisely as contemplated by the rules and by the parties’ agreement.”
