Zimmer Challenges Timeliness of Durom Hip Cup Lawsuit, Expert Testimony

NEWARK, N.J. –– Zimmer Inc. has challenged the timeliness of claims in a Durom Hip Cup suit pending in the national coordinated multidistrict litigation docket, arguing that the plaintiff’s suit is not timely under Louisiana’s one-year statute of limitations.

In the Jan. 15 motion filed in U.S. District Court for the District of New Jersey, Zimmer also argued that the plaintiff’s lawsuit is not support by sufficient expert opinion.

Christine Brady alleged that she was implanted with the Durom Cup in Aug. 2006. Six months after the surgery, Brady said she began experiencing an “unexpected gradual increase in pain.”
