Mirena MDL Judge Dismisses With Prejudice 31 Cases as Time-Barred

NEW YORK — The judge overseeing the Mirena intrauterine device multidistrict litigation has granted Bayer’s motion to dismiss 31 cases as time-barred under Louisiana, California, Oklahoma and Ohio law.
On Jan. 9, Judge Cathy Seibel of the U.S. District Court for the Southern District of New York further found that none of these plaintiffs’ claims are saved by the discovery rule because they were aware or should have been aware of the cause of their injuries within the limitations period.
