Texas Federal Judge Dismisses Out-Of-State Plaintiffs’ Claims in TVM Case, Stays Proceedings

HOUSTON — A Texas federal judge has dismissed transvaginal mesh claims brought against Ethicon Inc. and Johnson & Johnson by 95 out-of-state plaintiffs for lack of personal jurisdiction and stayed the proceedings pending possible transfer to the multidistrict litigation proceedings.

On Dec. 23, Judge Gray H. Miller of the U.S. District Court for the Southern District of Texas found he lacks general jurisdiction over the New Jersey-based defendants as to the non-Texas plaintiffs’ claims.
