RENO, Nev. — A Nevada federal judge has denied C.R . Bard Inc. summary judgment on claims of design and manufacturing defect and failure to warn asserted in an inferior vena cava filter case, ruling that the plaintiff has established questions of fact as to whether the alleged defects cause his injuries and whether his surgeon was adequately warned of the risks.
On Dec. 16, Judge Robert C. Jones of the U.S. District Court for the District of Nevada further ruled that he will most likely allow the plaintiff’s experts to offer testimony as to Bard’s testing of the device, …
