La. Federal Judge Reduces $9 Billion Punitive Damages Award to $36.875 Million in Actos Case

LAFAYETTE, La. — A Louisiana federal judge has reduced a $9 billion punitive damages award issued in an Actos bladder cancer case to $36.875 million, finding that although the original award was warranted, it was excessive under the Due Process Clause of the U.S. Constitution.

The revised award imposes punitive damages of against Takeda of $27,656,250 and against Lilly of $9,218,750, according to the Oct. 27 order issued by Judge Rebecca F. Doherty of the U.S. District Court for the Western District of Louisiana.

Terrence Allen took Actos from 2004 to 2011, when he was diagnosed with bladder cancer. …
