Ind. Federal Court Sees Jurisdictional Issue In Suit Against Stryker and ‘Doe’ Surgeon

TERRE HAUTE, Ind. — A federal judge in Indiana has ordered the parties to a Stryker Rejuvenate hip case to submit a joint jurisdictional statement addressing questions raised by Stryker’s removal of a lawsuit that also includes malpractice claims against a “John Doe” surgeon.
The Jan. 3 order by Judge Jane Magnus-Stinson of the U.S. District Court for the Southern District of Indiana acknowledges that plaintiff Billy L. Brauer was statutorily prevented from identifying the surgeon in any court documents while a medical review board investigates his malpractice claim.
