DePuy Opposes California Plaintiff's Motion for Expedited Trial on ASR Hip Claims

SAN FRANCISCO – A California plaintiff's bid for a preferential trial on his DePuy ASR hip implant claims would place an unfair burden on DePuy and is unnecessary given the defendant's offer to move quickly on settlement discussions, the company said in response to the motion.

DePuy responded Dec. 24 to the recent motion by plaintiff Gary Darling, whose case is pending in California's coordinated DePuy ASR proceedings in San Francisco Superior Court (DePuy ASR Hip System Cases, JCCP No. 4649 (Calif. Super. Ct., San Francisco).

Darling is a Connecticut resident who filed his lawsuit in Los Angeles County …
