NexGen MDL Court Orders Plaintiffs to Provide Design Defect Theories to Zimmer

CHICAGO — U.S. District Judge Rebecca R. Pallmeyer has granted in part a motion by Zimmer Orthopaedics to compel more specifics on design defect theories being advanced by plaintiffs in the NexGen Knee MDL.

Judge Pallmeyer’s Dec. 11 order was directed at 10 plaintiffs in representative “pool picks.” The judge stipulated that those plaintiffs need not respond to Zimmer’s interrogatory with “all facts” and “all documents” in support of their theories, which Zimmer had also requested.

The agreed order followed a directive to counsel to try to reach a resolution, the judge noted. The amended responses to the interrogatory must …
