Biomet MDL Judge Declines to Appoint Special Master for Pre-Trial Discovery Issues

INDIANAPOLIS — The federal judge presiding over the coordinated Biomet M2a Magnum Hip proceedings has denied a motion by plaintiffs to appoint a special master for pre-trial discovery, finding the appointment unnecessary.

Judge Robert L. Miller Jr., who oversees the Biomet cases in the U.S. District Court for the Northern District of Indiana, did authorize sitting Magistrate Judge Christopher A. Nuechterlein to resolve any discovery disputes, should Judge Miller be unavailable.

Judge Miller’s Dec. 10 order also provided for the separation of the cases into two tracks, with an initial emphasis on cases in which plaintiffs have undergone revision surgery, …
