Minn. District Court Defers Ruling on Remand and Stays DePuy ASR Hip Case

MINNEAPOLIS — A Minnesota federal judge has deferred ruling on a DePuy ASR hip plaintiff’s motion to remand and instead has stayed the case pending transfer to the federal multidistrict proceedings in the Northern District of Ohio.

Judge Ann D. Montgomery of the U.S. District Court for the District of Minnesota decided Nov. 8 that “uniformity, consistency, and predictability” required a stay until the Judicial Panel on Multidistrict Litigation decides whether to transfer the case to the MDL (In re DePuy ASR Hip Implant Products Liability Litigation, MDL No. 2197 [N.D. Ohio]).
