PHILADELPHIA — A Pennsylvania federal judge has refused to remand an OsmoPrep action to state court, finding the plaintiffs have no cause of action against the nondiverse healthcare defendant under the New Jersey Product Liability Act.

On Nov. 8, Judge Robert F. Kelly Sr. of the U.S. District Court for the Eastern District of Pennsylvania further ruled that private and public factors favor transfer of the action to the District of New Jersey.
