Ark. High Court Asked to Decide Whether Citizen Taxpayer May Sue Actos Makers on Behalf of State

LAFAYETTE, La. — The judge overseeing the Actos federal multidistrict litigation has certified to the Arkansas Supreme Court the question of whether an Arkansas citizen may bring an illegal extraction claim on behalf of the State of Arkansas against the makers of Actos.
On Nov. 7, Judge Rebecca Doherty noted that this case “involves important and determinative questions of Arkansas law as to which there is no controlling Arkansas precedent.”
Greg Bowerman sued Takeda Pharmaceuticals North America Inc. and Eli Lilly & Co. in the Saline County (Ark.) Circuit Court as the representative of a constitutional class of Arkansas taxpayers. …
