photo-7In the last few years, there has been a recent surge of pharmaceutical drug lawsuits driven in part by the success of the Fen-phen litigation. However, the attorneys that practiced pharmaceutical and medical device litigation prior to fen-phen knew that the results were not always positive (e.g. norplant, breast implants). The time and expense involved in these product liability lawsuits are tremendous, particularly in uncharted areas of litigation. As tort reform looms on the horizon in many states and on a federal level, the practitioner should proceed cautiously in this changing environment.
