Zimmer NexGen MDL Court Denies Motion to Strike Plaintiffs’ Bellwether Choice

CHICAGO — U.S. District Court Judge Rebecca R. Pallmeyer has denied Zimmer Inc.’s (NYSE: ZMH) motion to strike one of the plaintiffs’ choices from the list of bellwether trial cases in the coordinated NexGen Knee Implant litigation, apparently rejecting defendants’ assertions that the plaintiff’s failure to meet stipulated deadlines made him ineligible for trial selection.

Judge Pallmeyer, who presides over the NexGen Knee Implant Products Liability MDL in the U.S. District Court for the Northern District of Illinois, entered the order denying Zimmer’s motion to strike plaintiffs’ selection of Norman Blake v. Zimmer Inc., et al. (No. 1:12-cv-02836) Dec. 14.
