Ind. Court Denies Zimmer Employee’s Bid to Amend Dismissed ERISA Complaint

INDIANAPOLIS — A federal judge has denied a former Zimmer (NYSE: ZMH) employee leave to replead his securities fraud complaint alleging that the company failed to either adequately acknowledge problems with hip implant systems or protect employee investment plans from the adverse effects of claims by implant recipients.

Judge Sarah Evans Barker of the U.S. District Court for the Southern District of Indiana concluded Nov. 16 that allegations raised by Jonathan M. DeWald in a proposed second amended complaint would fail for the same reasons given by the court in its order dismissing the action nearly a year ago.
