5th Cir. Affirms Summary Judgment in Favor of GSK in Paxil Suicide Case

ATLANTA — A federal appeals court has affirmed a grant of summary judgment to GlaxoSmithKline (NSE:GLAXO) in a Paxil wrongful death case, finding that the plaintiff failed to establish a causal relationship between the drug and his minor son’s suicide.

On Nov. 5, the 5th Circuit U.S. Court of Appeals ruled that the trial court did not err in refusing to grant the plaintiff’s multiple requests for additional time for discovery and briefing. The plaintiff had ample opportunity over the six-year course of the litigation to establish causation, the appellate court reasoned.
