TAMPA, Fla. - Failure-to-warn claims brought against the maker of generic Reglan are federally preempted pursuant to the U.S. Supreme Court's recent ruling in Pliva v. Mensing, a Florida federal judge has ruled. Guarino v. Wyeth LLC, et al., No. 8:10-2885 (M.D. Fla.).
Claims that Teva Pharmaceuticals USA Inc. failed to adequately warn of the alleged link between the diabetes drug and tardive dyskinesia were dismissed with prejudice on Nov. 7 by Judge James S. Moody Jr. of the U.S. District Court for the Middle District of Florida.
