NEW ORLEANS - Metoclopramide injury claims brought under the Louisiana Products Liability Act fail because the plaintiff did not identify which defendant drug maker, if any, manufactured the drug she ingested, a federal judge has ruled. Rojas v. Qualitest Pharmaceuticals Inc., et al., No. 10-2281 (E.D. La.).
On Jan. 28, Judge Sarah S. Vance of the U.S. District Court for the Eastern District of Louisiana determined that the plaintiff did not meet the proximate cause requirement under the LPLA, therefore the suit must be dismissed.
