Pain Patch Cases Remanded to Pennsylvania State Court

PHILADELPHIA - A Pennsylvania federal judge has remanded five fentanyl patch death cases to state court, ruling that the sole Pennsylvania defendant, Mylan Inc., was not fraudulently joined because it was involved in managing regulatory compliance for the patch. Doran, et al. v. Mylan Inc., Nos. 10-6539, 10-6742, 10-6788, 10-6713, 10-6858

On Jan. 20, Judge Berle M. Schiller of the U.S. District Court for the Eastern District of Pennsylvania remanded the cases to the Philadelphia Court of Common Pleas.
