RALEIGH, N.C. - A case in which a Missouri woman alleges that she was injured by Panacryl sutures was remanded to state court by a federal judge who found that the Missouri-domiciled defendant was not fraudulently joined to defeat diversity. Engleman v. Johnson & Johnson, et al., No. 10-173 (E.D. N.C.).
On Jan. 5, Judge Terrence W. Boyle of the U.S. District Court for the Eastern District of North Carolina ruled that neither the Missouri Innocent Seller Statute nor the state's five-year statute of limitations bars the claims against MidWest Medical Supply.
