Wyeth Denied Summary Judgment on Majority of Claims in Prempro Case

SAN JUAN, Puerto Rico - A federal judge has denied Wyeth summary judgment on negligence and failure-to-warn claims brought in a Prempro injury case, finding issues of fact as to whether the drug maker provided a sufficient warning as to the risk of breast cancer. Rivera-Adams v. Wyeth, No. 03-1713 (D. Puerto Rico).

On Dec. 8, Chief Judge Jose A. Fuste of the U.S. District Court for the District of Puerto Rico did, however, grant the drug maker summary judgment on the punitive damages claim, ruling that it is barred by Puerto Rico law.
