Federal Judge Dismisses Suit Against Spinal Cord Device Maker

KNOXVILLE, Tenn. - A Tennessee federal judge has dismissed a suit filed against the manufacturers of a spinal cord simulation system device, ruling that the complaint fails to satisfy federal pleading requirements because it does not draw a causal connection between the plaintiff's alleged injury and the device. Maness v. Boston Scientific, et al., No. 3:10-178 (E.D. Tenn.).
On Nov. 4, Judge Thomas Phillips of the U.S. District Court for the Eastern District of Tennessee ruled that the plaintiff also failed to sufficiently plead that the device was defective.
