Federal Judge Dismisses Negligence Claim Against Pain Pump Manufacturer

MINNEAPOLIS - A Minnesota federal judge has dismissed a negligence claim brought against Stryker Sales Corp. in a pain pump injury action, ruling that it is abrogated under substantive Ohio law. Newman v. Stryker Sales Corp., No. 09-2866 (D. Minn.).

On Sept. 30, Judge John R. Tunheim of the U.S. District Court for the District of Minnesota also denied Stryker's motion to transfer the action to Ohio federal court, finding that at this stage of the litigation, transfer would not promote the convenience the parties and witnesses, nor serve the interests of justice.
