Seroquel Claims are Barred by Delaware Statute, Judge Rules

WILMINGTON, Del. - A Delaware state judge has dismissed with prejudice Seroquel injury claims brought by three out-of-state plaintiffs, ruling that they are barred by Delaware's two-year statute of limitations. Burrell, et al. v. AstraZeneca, et al., Nos. 07C-01-412 , 07C-04-110 and 07C-04-267 (Del. Super., New Castle Cty.).

Judge Joseph R. Slights III of the New Castle County Superior Court ruled Sept. 20 that the statute of limitations is applicable pursuant to Delaware's borrowing statute and was not tolled by the "time of discovery" exception or the fraudulent concealment doctrine.
