6th Circuit Denies DuPont’s Request to Revisit Order Affirming $40 Million Verdict in C-8 Testicular Cancer Case

CINCINNATI –– The 6th Circuit U.S. Court of Appeals has denied a petition for rehearing en banc, allowing to stand its prior decision affirming a $40 million verdict in which an Ohio jury found that DuPont’s alleged C-8 contamination of water sources from its West Virginia plant caused a man’s testicular cancer.

In a Feb. 1 order, the 6th Circuit wrote that it had reviewed the petition for rehearing, and “concludes that the issues raised in the petition were fully considered upon the original submission and decision of the case.”
