JPML Creates 2 Separate Insurer-Specific MDL Dockets for COVID-19-Related Ski Pass Insurance Suits

WASHINGTON, D.C. –– Two separate insurer-specific multidistrict litigation dockets have been created to handle cases involving ski pass insurance, with the U.S. Judicial Panel on Multidistrict Litigation sending cases to federal courts in California and Missouri.

In the Oct. 2 order, the JPML noted in its decision that it views requests to centralize claims filed against competing defendants in a single MDL with a “skeptical eye.”

The JPML explained that, at oral argument, the moving plaintiff indicated that he no longer sought centralization on an industry-wide basis, but instead suggested that the Panel create an MDL docket in the Western …
