TRENTON, N.J. –– The defendants in the national multidistrict litigation docket for talcum powder personal injury claims have backed their efforts to compel the testimony of Paul Hess, maintaining that they have been “rebuffed time and again in their efforts at the most basic discovery….”

In an Aug. 2 reply brief filed in the U.S. District Court for the District of New Jersey, the defendants argued that they are seeking “nothing more than their fundamental right under the rules of evidence to explore Plaintiffs’ case-defining asbestos theory.”
