J&J Opposes Motion to Quash Subpoena, Says Talcum Powder PSC Trying to Use Discovery As Both ‘Sword and Shield’

TRENTON, N.J. –– Both Johnson & Johnson and LTL Management have opposed a motion to quash a subpoena in the talcum powder multidistrict litigation docket, saying that because the Plaintiffs’ Steering Committee has not identified with particularity which documents are privileged, the defendants cannot “meaningfully assess or respond to the privileges.”

The talcum powder defendants filed an opposition brief on Jan. 22 with the U.S. District Court for the District of New Jersey saying that the information sought in its subpoena is not privileged or substantially overbroad.
